The purpose of this contract is to protect all parties: the Buyer, the Seller, and the cat or kitten. If there are any problems, questions, concerns, or issues that you need help with, your breeder is always here. We want the adoptive parent(s) and/or family to be completely happy with the new kitten and his or her transition to the new home. Transitioning is easy for some kittens but more difficult for others, and kittens/cats handle stress in various ways. If there are ANY issues please call Natalie at 239-206-2023 , who will provide you with all the help she can to make this time easier for the new parents and the kitten.

Terms of Contract
Deposit
A non-refundable deposit of $500 is required for reservation of the cat/kitten. Should the Buyer, after having paid the deposit, decide against purchasing the kitten, he or she forfeits the deposit. Deposits are non-refundable, but are completely transferable to any other upcoming litter and never expire. You may wait as long as you wish to find just the perfect kitten for you. No expiration date on deposits as long as Seller is breeding said breed. However, after a kitten is selected, the deposit is non-refundable and the sale is considered final.
Method of Payment
Deposit
The Buyer can make the deposit via cash, CashApp, or Zelle. By paying the deposit the Buyer indicates that he or she understands and agrees to abide by the terms stated in this contract.
Balance
The balance or remainder of the purchase price will need to be paid in cash (no checks) at the scheduled pick up date. If the kitten is being shipped/transported, the balance will need to be paid in full via CashApp or Zelle three (3) business days before shipment date.
The Buyer will pay all travel and shipping expenses. Should the Seller agree to help transfer the cat in person, any mileage will be at the expense of the Buyer.
General
No refunds will be given, all deposits are non-refundable and all sales are final.
If kitten sold as a pet, TICA pedigree is not included in price but can be provided for an additional fee.
If the Buyer cannot pick up the kitten within 5 (five) days after kitten is ready, the Buyer will be subject to the boarding fee of $15 a day. We will inform you in advance of the vaccinations schedule so you can make arrangements for the pick up within 5 (five) days if not discussed otherwise. If the Buyer is not confirming pick up date & time and not responding to the Breeder for over 48 hours, the kitten is considered abandoned by the client and listed back as available for sale, and the deposit is forfeited.
Spay/Neuter Agreement
This cat is being sold as a pet without breeding rights.
The Buyer agrees that the kitten will be spayed/neutered by the time the kitten reaches eight (8) months of age, at Buyer’s expense (if sold intact). Within fourteen (14) days of spaying/neutering, Buyer will provide the Seller with certified medical report showing proof of permanent spaying or neutering. It is the responsibility of the Buyer, not the veterinarian, to ensure that the Breeder has received verification of the performed surgery. Failure to comply with any of these terms shall constitute a material breach of this Agreement and shall void any and all Seller’s guarantee and obligations.

Health Guarantee
The Seller will provide purchaser with documented vaccinations necessary for kitten’s or cat’s age (see the attachment).
The Seller guarantees the kitten to be in good health at the time of pick up or delivery (to the best of the Seller’s knowledge). It will be the responsibility of the Buyer to have the kitten examined by a veterinarian within 48 hours. Within that 48 hour period, if found to be seriously medically deficient, the Seller will take the kitten back and refund payment, less the deposit and any shipping charges, under the following conditions: the Seller is provided with proper documentation, from a licensed veterinarian, stating the medical issue and that the cat is seriously medically deficient; a second examination by a veterinarian of the Seller’s choice corroborates these claims. This cat/kitten is not guaranteed against FIP (unless Option 2 is purchased). The health guarantee does not cover hypoglycemia, coccidiosis, giardia, herpes, upper respiratory infection, mites, ticks, fleas, ringworm, ear infection or any common treatable ailment once the kitten has left the seller’s hands due to these being often caused by stress of moving or easily picked up during travel after leaving our cattery.
Prior to mandatory 48-hours exam kitten must be quarantined. If the Buyer fails to complete this mandatory exam, this contract will be rendered null and void. If the kitten comes into contact with any animal prior to the exam, it will render this contract null and void. Veterinarian written proof of any life-threatening health issues found during the initial exam must be reported to the Seller within 24 hours. Administering of FIP or FeLv vaccine will void all warranty. It is the opinion of the Seller that these vaccines are not only controversial, but possibly harmful to the animal. Except for the 1-year rabies vaccination (non-adjuvant only), the Seller does not recommend annual vaccinations.
The Seller guarantees the cat against lethal hereditary defects for up to one year (12 months) from the kitten’s date of birth. Lethal hereditary defects include and are limited to only the following: feline leukemia, genetic conditions of the heart, eye, liver, and/or kidney. Should said cat/kitten develop a proven hereditary life-threatening illness or defect leading to death, a licensed veterinarian's written report and autopsy report, proving the cause of such illness or death originated at the Cattery, will be required before any adjustment will be considered. Seller's liability shall be limited to the original purchase price, to the original Buyer only of said cat/kitten and to replacement only. No refunds. The Seller will replace the cat/kitten with a cat/kitten at the Seller’s earliest convenience, should the following conditions be met: the Buyer provides the Seller with a necropsy report by a licensed impartial Veterinary Pathologist, at the Buyer’s expense, stating that the cause of death is unquestionably a hereditary or congenital defect; a second examination by a veterinarian of the Seller’s choice corroborates these claims.
Buyer understands that the following slight hereditary or congenital defects are not considered serious or life threatening and therefore are not covered by this guarantee: umbilical hernia, inguinal hernia, cherry eye, undescended testicle, underbite or overbite, grade 1-2 heart murmur, grade 1-2 patellas, retained teeth, deafness or physical flaws. In addition, we make no guarantee on eye color, coat length, mature size, weight, conformation.
Seller assumes no responsibility of said kitten after the kitten leaves the seller’s premises for medical expenses, disease, mortality, landlord disapproval, allergies, shedding, temperament/personality, size, training, disagreement of the family, or any other reasons not related to genetics, and no replacement kitten or refund will be given.

Health Guarantee (continued)
Seller assumes no liability or responsibility for any veterinary care for this cat after the Buyer takes possession of said cat. Under no circumstances will the Seller be responsible for any veterinary bills incurred by the Buyer. Veterinary expenses, shipping expenses, and other cat-related purchases/expenses incurred after the cat/kitten leaves the cattery are the sole responsibility of the Buyer.
Pet insurance is responsibility of the Buyer. Purchasing pet insurance is required to protect the health and safety of the kitten and to manage potentially high, unexpected veterinary costs for accidents or illnesses.

The Buyer agrees that the Seller will be able to discuss freely the kitten/cat’s health information, sterilization status, and well-being with the Buyer’s veterinarian; due to privacy matters, the Buyer agrees to notify his or her veterinarian as to this agreement.

Treatment of Cat
Under NO circumstances shall this kitten be de-clawed. Declawing is an amputation of end bones of the animal toes. Declawing is extremely cruel and mutilating surgery, after which cat will be in pain, may also have bleeding, swelling and infection. According to study, 42% of declawed cats have ongoing long-term pain and 25% are limping. Declawed cats are more likely to have health problems such as back pain, or behavioral problems, such as aggression or litter box problems (“inappropriate elimination”). This can lead to abuse or abandonment of the cat/kitten, a risk that the seller is not willing take. The Buyer agrees to, under no circumstances, allow the cat to be declawed. Declawing will void any and all Seller’s guarantee and obligations.
Under NO circumstances shall this kitten/cat be permitted to roam freely outdoors unless accompanied by human supervision and on a lead/harness or in enclosed safe kitten habitat.
Under NO circumstances shall this kitten/cat be tattooed, pierced, or undergo any unnecessary "fashionable" body modification.
The new cat should be confined to a private room with toys, food, the kitten’s litter box, and plenty of human contact until accustomed to his/her new surroundings.
Seller will provide an information of the foods and supplements the cat has been eating, as well as a recommended water fountain and litter types. Please be careful that his/her diet is not changed drastically. The Seller will make her best effort to send home with you a sample of dry and wet foods the cat is eating, to help Buyer through the first few days.

Relinquishment of Ownership of Cat or Permanent Transfer of Cat by Buyer
The Buyer agrees that under NO circumstances will the kitten/cat EVER be sold or given to a pet shop, animal shelter, research laboratory, or similar facility. Should the Buyer, for any reason, including death, not be able to keep the above kitten, the Seller will be given the first option of rescuing the cat.
If the Buyer has a living trust, the previous clause must be made note of in the trust; if the Seller deems another interested party (e.g., family member of buyer; close friend of
buyer) a desirable and willing owner, the Seller will seriously consider transferring ownership of aforementioned cat.
If the Buyer decides that he or she no longer wants the cat, regardless how many years have passed since purchase of the cat/kitten, the Seller will be given the first option of rescuing the cat.
Breach of Contract
In the event the Buyer is found to have violated any of the terms and conditions of this contract, the cat is to be surrendered unconditionally to the Seller. Seller may reclaim physical and legal ownership of cat with or without due process of law for any breach of contract with no refund of purchase price.
In the event the Buyer is found to have violated any of the terms of this contract, Buyer shall be liable to the Seller for damages in the amount of two times the purchase price of said cat/kitten, plus expenses for veterinarian care upon return of cat/kitten to Seller and all attorney, legal and related miscellaneous fees that result in litigating this contract. Any legal action, which may arise under the terms of this contract, will be brought in the county/city of Seller’s residence.
Attorneys Fees and out−of−pocket costs
Should Buyer breach this Contract, Buyer is responsible for any and all costs resulting from the litigation of this Contract, the amount of purchase of kitten, shipping expenses, associated veterinary expenses, and any damages caused to the reputation of seller.
THE SELLER WILL NOT BE LIABLE THE BUYER FOR ANY DAMAGES THAT EXCEED THE PURCHASE PRICE PAID FOR THE KITTEN.
